Discusses background and application of two major forms of U.S. trade remedy law, antidumping law and countervailing duty law (CVD), to non-market economies (NME). Covers 2007 Department of Commerce decision to change its long-standing policy and apply CVD law to NME goods, and reviews Chinese case in World Trade Organization challenging U.S. application of CVDs to Chinese products. Examines Dec. 2011 decision of U.S. Court of Appeals for the Federal Circuit holding that the Department of Commerce may not apply CVDs to NME country goods and must seek new legislative authority in order to do so. Addresses subsequent legislative and judicial developments, and summarizes earlier legislation addressing CVDs and NMEs.
