Burton died in 1841, indebted both on his own account as surety to others. His will appointed executors and directed that the his estate be sold to pay first his own debts and then others'. A bill was subsequently filed by various creditors praying for an account of the estate and the debts to be settled. These included a debt to Henry Fullenwider, from whom Burton had bought slaves, land and an iron factory, for [dollars] 16,946.45. The court ruled on various points, including that Fullenwider's debt should be paid in preference to any others. Various parties disputed the ruling, and the case went to the Supreme Court, which amended the judgment somewhat.
