- The plaintiff was indebted to Stancell for [dollars] 50.69 and to Henry Deberry for a further sum. In execution of these debts the constable, Long, seized the slave girl called Irena. Unable to pay these debts, but wanting to avoid losing his slave at the execution sale, the plaintiff applied to Deberry, who was a magistrate, to lend him the money. He conveyed the slave to Deberry to secure the sums owing and authorised Deberry to sell the slave as soon as he could at the best price possible. The plaintiff's bill claims that the bill of sale for the slave girl was merely intended by both parties as security. On its face however it was an absolute bill of sale as recommended by Deberry as this would make it easier for him to sell the slave with clear title. The plaintiff wanted the deed declared merely a security. The bill of sale had never been registered or proved. The slave girl was valued at [dollars] 250 at the end of 1843 by two people as Deberry had decided to keep the girl for himself. He then died soon after and Irena was included in the division of slaves made when his estate was settled. This bill was filed in May 1847 against the executor and legatees for an account and redemption. Disparity between the real value and the alleged price. The plaintiff had been offered about [dollars] 200 for her. Verdict for the plaintiff. He was entitled to redeem the slave. Moore also owned Irena's mother and two other slave children.
