- A financial dispute between creditors of the late Auguste Tete and his widow. Her husband had bought property at the succession sale of his wife's father and gave promissory notes for the purchases. These notes were given back to him in settlement of his wife's share of the succession. She had a legal mortgage against his property for the value of these notes, which was still valid as he had been solvent at the time he received them. At a meeting of creditors she represented that she was a mortgage creditor herself for the sum of [dollars] 17,849-25. Which creditors would take priority? The manuscript case file includes a financial valuation in French of the estate of Auguste Tete and folios 10-12 of this file provide a list of slaves, their ages, their children, and their respective values, as well as some information about them. For instance, Justine was the cook. Tete possessed a sugar mill, a steam mill and a cotton mill, as well as a main residence in the Bayou de Lafourche area. The District Court had found for Mrs Tete (the widow). Chief Justice Eustis found for the creditors, Blanchard, Eimer and Company, over Mrs Tete, though Justice Slidell dissented. Justice Preston had recused himself because of a conflict of interest. Chief Justice Eustis referred to a similar case involving the same succession, Slatter v Tete, but in this instance the husband had not been solvent at the time of receiving the notes. The Supreme Court allowed a re-hearing because of the split decision. It subsequently set its own verdict aside and ordered a new trial. The case was further complicated by the misdemeanor of the relevant notary public.
