- Summary:
- An action brought by Peter O'Neal, plaintiff and administrator of the succession of Nancy Oates, against Jane Oates, defendant and daughter-in-law of Nancy, for the recovery of a female slave and child whom the plaintiff holds to be the property of the estate. The defendant, guardian of her son William Thomas Oates, a minor, claims rightful possession of both slaves on his behalf, claiming that Nancy had divided her slaves amongst her children and the two in dispute were given to Nancy's son, Henry Oates, husband of the defendant. The defendant contested the right of the administrator to take the slaves out of her possession and claimed that no debts were owed as a basis for their recovery. The original ownership of the slaves by Nancy Oates and the position as heir, of the minor, William, were both affirmed by the District Court. Judgment affirmed.
