- The plaintiff sued for damages alleged to have been sustained by him in consequence of his slave being detained and employed on board of the defendant's tow-boat. The defendants denied the charge, arguing that the slave was at the time in the possession of Gustave Moussier who allowed the slave to hire himself out. The jury for the District Court gave a verdict for the plaintiff for [dollars] 150 and the defendants appealed. The defendants offered parole evidence to show that after the sale of the slave to the plaintiff he allowed Moussier to resume possession of him, and that Moussier owned him at the time of his employment on the tow-boat. A receipt of Moussier was offered, with a witness, but was rejected on the ground that it did not bear the signature of the plaintiff. Moussier could not give a valid release as he no longer had any title to the slave. The court affirmed the judgment of the District Court.
