- Redhibitory action for the rescission of a female slave and her two small children on the ground of defects and diseases in the woman. Also to recover the price paid of [dollars] 1800, plus damages. Shortly after the sale, the plaintiff discovered that the slave suffered with rheumatism and could not work effectively. The defendant, Ware, refused to refund the price. There was a verdict and judgement rescinding the sale, and for the return of the price paid for said slaves. The defendant appealed, claiming that he had not agreed to a refund as he was acting on behalf of a person in Mississippi. Instead he offered to give other slaves in exchange. The plaintiff declined. The Supreme Court noted that with the defendant making this offer the plaintiff was able to institute her action. It ordered that the judgement of the District Court be affirmed with costs.
