Plaintiff, a freed woman of colour, seeks to claim a legacy that Douglas Wilkins to bequeathed their child. The child had died before the testator, and the court considered whether or not the the legacy had lapsed by the child's death and fallen to the residuary legatee. Douglas Wilkins had bequeathed that upon his death, the plaintiff and her children should be emancipated, and that the children should be sent to a state where slavery was not allowed and given an education there. Judgement affirmed for the plaintiff.
