- Summary
- A case concerning an action by the plaintiff to recover a slave called Adam from the defendant. The plaintiff sold the slave boy, Adam, to the defendant in 1846 with a specific written contract giving Matthews the right to redeem the slave at the end of the year 1846 or 1847 by paying Wilson [dollars] 300 with 10% interest. Wilson was to allow [dollars] 8 per month for the hire services of the slave during the time he was in his possession, as well as agreeing to clothe and feed the slave. If Matthews failed to redeem the slave at the end of 1846, Wilson would pay Matthews a balance of [dollars] 200 and keep the slave boy. The defendant left Arkansas (where the sale was made) in the summer of 1846 to go to Louisiana and took the slave with him. The plaintiff made two attempts to come to a settlement with the defendant in 1847. The plaintiff first sent his agent and then went in person. This time the defendant again refused to give up the slave and threatened to kill the plaintiff if he did not get off his land. The slave had been sold as the security for a debt. The verdict for the plaintiff in the court below was affirmed. The decision of the district court was amended so that the plaintiff could recover from the defendant wages at a rate of [dollars] 8 per month for the services of the slave from 22 November 1849 until the slave was delivered back to the plaintiff.
