Overton had entered an agreement with Gervais whereby he was to receive deliveries of cotton in three installments over the year. He also took out a security on the debt against the property of the defendant. After the failure of Gervais to deliver the first installment of cotton Overton took action against the property of Gervais. This included a number of slaves which Overton said he would drop his suit, but the defendant did not comply with this. The plaintiff was successful in this supreme court hearing with the judge ordering the payment of the total debt with interest by Gervais.
