Powell was convicted of larceny. He appealed on the basis that he was of unmixed African blood and therefore should be presumed to be a slave, and that, as such, the lower court had had no jurisdiction to try him. The Supreme Court ruled that he had been tried as a free man of colour and there was no evidence to rebut this presumption; though he had not been explicitly described on the indictment as a free man of colour, this was not a strict requirement. Judgment affirmed.
