An appeal taken by the plaintiffs, the heirs of Stephen Henderson, from a former judgment. They requested several shares of the assets of the succession, which the defendants insisted were their right to retain. The Court concluded that no action could be maintained against the executors for the recovery of the legacy. They were not authorised to retain the funds of the succession.
