- Summary:
- James G Stalling was staying at John H Mann's house and Stalling was in deteriorating health. Mann wrote Stalling's will whilst he was staying with him. The signing of the will was witnessed, though the will was not read out before signing. Mr Stalling died four days later. Mann was named the executor of the will and also a beneficiary. Argument revolved around whether it was legal for Mann to write the will to which he was executor and from which he benefitted by the bequest of seven slaves. Was Mr Stallings fully aware of the content of the will and was he pressurised into agreeing to the will? Witnesses were called on both sides. Judgment in favour of the propounder of the will was affirmed.
