- An action to recover a slave and her son brought against Wellborn by the children of his wife by a former husband. The slaves had formerly been the property of Joshua Elder, deceased; he delivered them to his daughter Sarah on her marriage to Seaborn B Garnett, the father of the plaintiffs. Whether this delivery was a loan or a gift was in dispute. After Garnett's death Sarah, in 1838, married Wellborn, before which the slaves were taken away form her by Elder. In 1842 Elder drew up a deed of gift conveying the slaves to the plaintiffs, which he instructed an agent to deliver to the donees only after his death; he died in 1851 and the donees began this suit. The jury found for the complainants and Wellborn moved for a new trial. The Supreme Court reversed the judgment, finding that the plaintiffs could not claim the slaves under the instrument drawn up by Elder as a deed; if it was valid it was a testamentary paper and should be proved accordingly.
