- Complaint for the recovery of a mule. The defendant, formerly the slave of McEachin, was in 1857 given by verbal gift to the wife of the plaintiff and was put on wages in the latter part of 1865 as a hired servant. Parker found a mule that had been abandoned by General Sherman's army. Both parties claimed the mule. Discussion by Chief Justice Pearson of the rights of owners of slaves to things found by their slaves and also the treatment and conditions of slaves in North Carolina during the period of military occupation before the passage of the act of Emancipation. The plaintiff and the defendant both used the mule for a period of time and it was kept with the plaintiff's stock and fed with the other livestock. The defendant suggested that he take it elsewhere, but the plaintiff refused to let it go. In July 1868 the defendant got possession of the mule with assistance of the military. Then by means of legal action the plaintiff got it back. The defendant appealed to the Superior Court where he was successful in getting judgment in his favour. This meant that the plaintiff in turn appealed to the Supreme Court. Counsel for the plaintiff said that the slave was not free until the act of emancipation and as a slave he could not own property. It decided that Parker was a freeman and could keep the mule. It was worth [dollars] 150 and could be hired for 50 cents a day. Verdict in the Superior Court affirmed.
