- The plaintiff's bill stated that in 1836 Hardy Jones and Willie Jones formed a partnership to buy and sell slaves on the following terms: Hardy was to advance [dollars] 3,350 to Willie and Willie to add one third as much; Willie was then to buy slaves with the money and transport them to Alabama, paying expenses out of his own pocket; he would then sell the slaves and divide any profit equally between himself and Hardy. The bill then stated that Willie did this and made a profit, but that Hardy died in 1837 without receiving any returned capital or profits. Hardy's executor, Nathaniel Jones, therefore brought suit against Willie for settlement, and the parties gave their consent for the court to define the nature of the account between them. In answer, Willie deposed that the agreement had been different, in that the expenses of transporting the slaves were to come out of the general fund, and that he paid Hardy [dollars] 1,000 as his share of the profit, which Hardy accepted. They then regarded the partnership as closed; there was no receipt for the profits handed over, nor any written partnership agreement, because Hardy was Willie's uncle and friend. After the court gave its verdict, Willie objected, inter alia, that the court had not awarded him a payment for expenses of [dollars] 397.65 and that it had not enquired into the terms of the partnership, and appealed to the Supreme Court. The Supreme Court did not accept any of Willie's objections, and ruled that the verdict stood.
