- The bill charged that Love had entered into an agreement with Raper to sell to him three slaves, a husband and wife and their child, for [dollars] 2,000, which money was to be paid by one Thomas out of funds held by him that were owing to Raper. Thomas subsequently refused to pay Love, after which Raper assured Love that he would pursue the matter and, if unsuccessful, would return the slaves. Raper later sold the slaves on to two men who removed them from the state; the bill prayed that Raper pay Love the [dollars] 2,000. In his answer, Raper stated that he had several times offered to return the slaves to Love if he could not secure his money from Thomas, but that he had not received any notice from Love that he had not secured it until the commencement of the present suit. The Supreme Court found that by his slowness (two years) in demanding payment of the of the bill by Raper himself, Love discharged Raper from being liable and, by the terms of their sale agreement, made the sale of the slaves to Raper absolute.
