Summary
James Williamson & Co bought two slaves, Ephraim and James, for [dollars] 2,200 from John Butler, who was acting as Wyatt Canaday's agent. The deed of sale signed by Butler contained a warranty of soundness but the defendants subsequently discovered that Ephraim was suffering from smallpox, from which he went on to die. The defendants sued for damages, but Canaday's counsel contended that an action could not be brought against him as he had not signed the deed. The jury found for the plaintiffs and the defendant appealed. The Supreme Court dismissed claims that Canaday could not be held liable but, after a lengthy discussion pertaining to the damages payable, amended the judgment so that the plaintiffs were liable for some costs. Otherwise, judgment affirmed.
