- The bill was an action of debt before a single Justice of the Peace by which Cantrell, an overseer of the roads, attempted to recover from Pinkney [dollars] 12 to cover four days' work on the roads by three slaves owned by Pinkney which they had not undertaken. A judgment was given for Cantrell, whereupon Pinkney appealed to the Superior Court. This heard that Pinkney resided for eight months of the year in South Carolina and for the remaining four months in North Carolina. The slaves in question travelled between the Carolinas with him. Pinkney's argument for his slaves not having to work on the roads was his residence and exercise of suffrage in South Carolina, but the court also heard that he claimed residence in Henderson county in order to qualify for exemption from the county's road tolls. The Superior Court found again for Cantrell, and Pinkney appealed to the Supreme Court. This found that Pinkney was ordinarily resident in North Carolina for a third of his time and so was liable during that time to send his slaves to work on the roads. Judgment affirmed.
