The prisoner had made two confessions and the first of these had been extorted from him by the use of force and threats. The Judge said that the officer concerned should be indicted and punished for his unlawful and tyrannical abuse of power. The prisoner, a man of colour had been living with a woman who had also been living with the deceased. Fisher was accused of the murder of Elijah Hassell. He had said: yes master Johnson, they have got me now, but I didn't intend to kill Hassell; it was dark, and the shot went higher than I intended. The confession which had been extorted under duress was ruled to be invalid. This did not prevent the late confessions, in circumstances without any duress from being entered as evidence. The defence counsel tried to get the charge altered to manslaughter because it was argued that the adultery had been a provocation. The murder verdict was affirmed by the Supreme Court.
