- Critcher borrowed 70 from Walker and lent him in return a slave, Mag, with the understanding that if the money borrowed was repaid by a certain date then Mag would be returned to Critcher. Twelve years after the transaction, Critcher attempted to pay the money and take possession of Mag and the children she now had, but his payment was refused. He then sued, his counsel arguing that the transaction amounted to a mortgage and so was redeemable at any time. The court determined that under their agreement Critcher was to bear the loss in the event of Mag's death before a certain date and Walker after that date, which made the transaction a conditional sale and not a mortgage; it therefore found for the defendant.
