- Case relating to the substantial estate of Thomas Beale Jr following his death and the death of his father, Thomas Beale Sr. The plaintiff, Mrs C. Delancy, the mother of Thomas Beale Jr, obtained a rule against Grymes and Canonge regarding their bond for them to pay into the court the sum of 3,500 dollars, or for them to show cause to the contrary. The defendants argued that the money had been taken out of the court by Grymes, as attorney and counsel Celeste Granpre¿¿ (widow of Thomas Beale, Sr), in her own right as tutrix of the minor children. It was her money as part of the overall estate settlement. Grymes said that he could not get material evidence from witnesses in Missouri and France. Legal arguments about the merit of the rule. The appeal by Mrs C. Delancy was dismissed. Similar case to Kenner v Young in which a rule absolute had been made by which the latter had been required to deposit into court the price he had agreed to pay for certain slaves.
