The petition in this case was granted, but only to a limited extent on the same basis as the arguments given in 1 Mo. 685, p.489. The Supreme Court took account of the fact that the Circuit Court had overlooked the point that the marriage contract between Douchouquette and Charleville had stated that Douchouquette would only have rights to property after Charleville's death if there had been no issue from the marriage.
